Contact: hello@hkcardcoll.hk本服務條款及平台政策適用於你使用 HKCardColl 的所有情況。當你存取或使用 HKCardColl，即表示你同意受本條款約束。These Terms and Platform Policy govern your use of HKCardColl. By accessing or using HKCardColl, you agree to these terms.

## 1. 關於 HKCardColl / About HKCardCollHKCardColl 是為香港 Pokémon TCG 收藏家而設的平台。本 App 提供卡價參考、AI 掃描、收藏管理、作品集追蹤、listing、認證商戶、社交帖子、訊息及買取查詢等工具。HKCardColl is a platform for Pokémon TCG collectors in Hong Kong. The app provides tools for card price reference, AI scan, collection management, portfolio tracking, listings, verified merchants, social posts, messages and buy-in enquiries.HKCardColl 是平台及資訊服務。我們並非用戶、賣家或商戶之間任何交易的一方。HKCardColl is a platform and information service. We are not a party to transactions between users, sellers or merchants.

## 2. 帳戶責任 / Account Responsibilities你同意 / You agree to:- 提供準確及最新的帳戶資料 / Provide accurate and current account information
- 妥善保管你的登入方式 / Keep your login method secure
- 只使用你自己的帳戶 / Use only your own account
- 不冒充其他人士、店舖或機構 / Not impersonate another person, shop or organisation
- 不使用 HKCardColl 進行詐騙、垃圾訊息、騷擾或非法活動 / Not use HKCardColl for fraud, spam, harassment or illegal activity你須對你帳戶下發生的活動負責。
You are responsible for activity that occurs under your account.

## 3. 用戶內容 / User Content你可以上載或發布內容，包括個人檔案資料、帖子、評論、圖片、listing、卡牌紀錄及商戶資料。You may upload or publish content, including profile information, posts, comments, images, listings, card records and merchant information.你保留自己內容的擁有權。當你將內容上載至 HKCardColl，即表示你授予我們一項非獨家、全球性、免版稅的授權，讓我們可為營運及改善平台而託管、儲存、處理、顯示、分發及使用該內容。You retain ownership of your content. By uploading content to HKCardColl, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, display, distribute and use that content as needed to operate and improve the platform.你不得上載以下內容 / You must not upload content that:- 違法、誤導、欺詐或有害 / Is illegal, misleading, fraudulent or harmful
- 侵犯知識產權 / Infringes intellectual property rights
- 包含色情、仇恨言論、威脅或騷擾 / Contains pornography, hate speech, threats or harassment
- 未經同意包含他人的個人資料 / Contains another person’s personal data without permission
- 宣傳詐騙、假貨或不安全活動 / Promotes scams, counterfeit goods or unsafe activity
- 誤導卡況、grade、真偽或價格 / Misrepresents card condition, grade, authenticity or price我們可按平台判斷移除、隱藏、限制或審核內容。
We may remove, hide, limit or moderate content at our discretion.

## 4. 市場及 Listing / Marketplace and ListingsHKCardColl 允許用戶及商戶建立 listing 及查詢。你同意 / HKCardColl allows users and merchants to create listings and enquiries. You agree that:- Listing 資料必須準確，不得誤導 / Listing information must be accurate and not misleading
- 卡況、語言、grade、版本及價格應清楚列明 / Card condition, language, grade, version and price should be stated clearly
- 已評級卡牌不得使用虛假或誤導性的 grade 資料 / Graded cards should not be listed with false or misleading grade information
- 不得刊登仿冒、改造、盜取或未經授權的商品 / Counterfeit, altered, stolen or unauthorised goods are not allowed
- 賣家及商戶須對自己的 listing、價格及交易負責 / Sellers and merchants are responsible for their own listings, prices and transactions
- 買家須在完成任何交易前自行核實商品資料 / Buyers are responsible for checking item details before completing any transactionHKCardColl 不保證任何 listing 一定會促成交易。
HKCardColl does not guarantee that a listing will result in a transaction.

## 5. 認證商戶 / Verified Merchants認證商戶狀態表示該商戶已向 HKCardColl 提交資料作審核。Verified merchant status means that a merchant has submitted information for review by HKCardColl.認證狀態並不代表 HKCardColl 保證 / Verified status does not mean that HKCardColl guarantees:- 該商戶刊登的每一件商品 / Every product listed by the merchant
- 該商戶提供的每一個價格 / Every price offered by the merchant
- 任何交易結果 / The outcome of any transaction
- 每件商品的真偽或狀況 / The authenticity or condition of every item如我們認為基於平台安全、合規或用戶信任有需要，我們可批准、拒絕、暫停或移除認證商戶狀態。

## 6. 平台角色及交易免責聲明 / Platform Role and Transaction DisclaimerHKCardColl 提供發現、溝通及紀錄工具。我們不會 / HKCardColl provides tools for discovery, communication and record keeping. We do not:- 處理用戶之間的付款 / Process payments between users
- 代持款項或提供 escrow 服務 / Hold funds in escrow
- 擔任買家、賣家、經紀或代理 / Act as buyer, seller, broker or agent
- 保證交付、付款或交易完成 / Guarantee delivery, payment or transaction completion
- 保證商品真偽、評級或狀況 / Guarantee product authenticity, grading or condition
- 解決用戶之間的每一項爭議 / Resolve every dispute between users用戶在交易、買賣或與他人見面前，應自行作出核實及判斷。
Users should make their own checks before trading, buying, selling or meeting another party.

## 7. 價格資料及作品集估值 / Price Data and Portfolio EstimatesHKCardColl 顯示的卡價、作品集價值、圖表及市場參考資料只供參考。相關資料不構成財務建議、投資建議、估值建議，亦不保證轉售價值。Card prices, portfolio values, charts and market references shown in HKCardColl are for reference only. They are not financial advice, investment advice, valuation advice or a guarantee of resale value.實際價格可能受卡況、grade、語言、版本、市場需求、賣家信譽、地點、付款方式、時間及買賣雙方協議影響。You should not rely solely on HKCardColl price data when making purchase or sale decisions.

## 8. AI 掃描免責聲明 / AI Scan DisclaimerAI 掃描用於協助識別卡牌，並加快收藏或 listing 流程。AI 掃描結果可能不完整或不準確。你須在儲存、刊登或分享前，自行核實卡名、系列、語言、grade、卡況及其他資料。AI scan is provided to help identify cards and speed up collection or listing workflows. AI scan results may be incomplete or inaccurate. You are responsible for checking and confirming card name, set, language, grade, condition and other details before saving, listing or sharing.

## 9. 禁止行為 / Prohibited Conduct你不得 / You must not:- 上載虛假、誤導或欺詐性 listing / Upload fake, misleading or fraudulent listings
- 出售仿冒、改造或盜取的卡牌 / Sell counterfeit, altered or stolen cards
- 誤導 PSA、BGS 或其他評級資料 / Misrepresent PSA, BGS or other grading information
- 騷擾、威脅或辱罵其他用戶 / Harass, threaten or abuse other users
- 爬取、抓取、反向工程或攻擊平台 / Scrape, crawl, reverse engineer or attack the platform
- 上載惡意軟件或有害程式碼 / Upload malware or harmful code
- 建立多個帳戶以規避限制 / Create multiple accounts to evade restrictions
- 使用 HKCardColl 進行非法活動 / Use HKCardColl for illegal activity
- 干擾平台安全或正常運作 / Interfere with the security or operation of the platform如帳戶違反本條款，我們可暫停或終止該帳戶。
We may suspend or terminate accounts that breach these terms.

## 10. 審核及執行 / Moderation and Enforcement為保護用戶及營運平台，我們可審閱帳戶、listing、帖子、圖片、訊息及商戶資料。We may review accounts, listings, posts, images, messages and merchant information to protect users and operate the platform.我們可採取的行動包括 / We may take action including:- 移除內容 / Removing content
- 隱藏 listing / Hiding listings
- 限制功能 / Restricting features
- 暫停帳戶 / Suspending accounts
- 移除認證商戶狀態 / Removing verified merchant status
- 在有需要時向相關機構報告嚴重事項 / Reporting serious matters to relevant authorities where required

## 11. 知識產權 / Intellectual PropertyHKCardColl 的名稱、標誌、介面、設計、文字及原創內容，屬於 POTO Creative Tech Limited 或其授權方。未經許可，你不得複製、修改、分發或使用 HKCardColl 品牌資產。Pokémon、Pokémon TCG、相關名稱、圖像、角色及商標屬其各自權利人所有。HKCardColl 與 Nintendo、Creatures Inc.、GAME FREAK inc. 或 The Pokémon Company 並無關聯、認可或贊助關係。

## 12. 服務可用性 / Service Availability我們會盡力保持 HKCardColl 可用及穩定，但不保證服務不會中斷或完全沒有錯誤。我們可隨時修改、暫停或停止任何功能，包括價格資料、AI 掃描、listing、商戶工具、社交功能或訊息功能。

## 13. 責任限制 / Limitation of Liability在法律允許的範圍內，HKCardColl 及 POTO Creative Tech Limited 不就以下事項承擔責任 / To the extent permitted by law, HKCardColl and POTO Creative Tech Limited are not liable for:- 用戶之間交易所產生的損失 / Losses from user-to-user transactions
- 不正確的 listing 資料 / Incorrect listing information
- 不正確的價格參考或作品集估值 / Incorrect price references or portfolio estimates
- AI 掃描錯誤 / AI scan errors
- 商戶或賣家的行為 / Merchant or seller conduct
- 服務中斷 / Service interruptions
- 因我們合理控制範圍以外的事件導致的資料損失 / Loss of data caused by events outside our reasonable control
- 間接、附帶或 consequential 損失 / Indirect, incidental or consequential losses本條款不排除任何根據適用法律不可排除的責任。
Nothing in these terms excludes liability that cannot be excluded under applicable law.

## 14. 帳戶暫停及終止 / Account Suspension and Termination如你違反本條款、對其他用戶造成風險，或以可能損害平台的方式使用 HKCardColl，我們可暫停或終止你的帳戶。We may suspend or terminate your account if you breach these terms, create risk for other users, or use HKCardColl in a way that may harm the platform.你可隨時停止使用 HKCardColl，並要求刪除帳戶。
You may stop using HKCardColl at any time and request account deletion.

## 15. 條款變更 / Changes to These Terms我們可能不時更新本條款。如變更屬重大，我們會透過 App、網站或其他合理方式通知用戶。We may update these terms from time to time. If changes are material, we will notify users through the app, website or other reasonable means.在條款更新後繼續使用 HKCardColl，即表示你接受更新後的條款。
Continued use of HKCardColl after changes means you accept the updated terms.

## 16. 管轄法律 / Governing Law本條款受香港特別行政區法律管轄。任何因本條款或你使用 HKCardColl 而引起的爭議，均受香港法院管轄。These terms are governed by the laws of Hong Kong Special Administrative Region. Any dispute arising from these terms or your use of HKCardColl will be subject to the jurisdiction of the courts of Hong Kong.
